This website is operated by DENÓMADE. Throughout the site, the terms “we”, “us” and “our” refer to DENÓMADE.

DENÓMADE offers this website, including all information, tools, and services available from this site to you, the user (hereafter, “you”, “your”, “yours”, “customer”, “customers”, “client”, “clients”), conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By using this website and placing orders on it, you agree to:

1. Use this website for legally valid consultations or orders only.
2. Not place any false or fraudulent orders. In case of detecting this kind of activity, we reserve the right to cancel these orders and to inform the relevant authorities.
3. Provide your email address, postal address, and/or other contact information truthfully and correctly, as well as current, complete, and accurate purchase and account information for all purchases made at our website. If you do not provide us with all this information, we will not be able to process your order.

When placing an order through this website, you declare that you are at least the age of majority in your state or province of residence and that you have the legal capacity to enter into contracts.

DENÓMADE offers its products solely to end-users. The acquisition of our products to resell them or to any other commercial purpose is not permitted. 

You must not transmit any worms, Trojans, viruses, logical bombs, or any code of a destructive nature. Anyone in breach of any of these Terms will immediately no longer be authorized to use this website.

We reserve the right to refuse the use of this website and to purchase any product through the website to anyone for any reason at any time. 

ORDERS

Most of DENÓMADE products are made-to-order especially for you, so we have set 7-9 business days for products to be made. Quality and care during this process are our priority. For this reason, this period may vary according to demand. We will inform you about the said period on our website and it will be established by strict order of reception.

For the rest of the products which are not made-to-order, we have set 1-3 business days so that the order may be processed.

Once your order has been dispatched, you will receive a tracking number and a direct link by email that will allow you to check the status of your order.

SHIPPING

In order to guarantee security and speed, all DENÓMADE orders are shipped using high quality courier services.

All DENÓMADE deliveries to the European Union are free of cost.

Shipments price to destinations outside the European Union is 18€*

*Additional shipment charges may apply to remote or non-metropolitan zones.

*Remote or non-metropolitan zones may expect delays respecting this time.

Please, take into account that most international orders may incur customs fees upon arrival to the destination. These fees, established by the destination countries, are entirely outside of our control, and we are not responsible or liable for any such fees upon arrival. When required, customers will be contacted via the shipping service to pay these dues in order to receive the package. For more information, you shall contact the competent authorities of your country.

 

DELIVERY

Product risks and ownership shall be your responsibility from the moment of delivery.

All DENÓMADE orders are properly packaged and wrapped to prevent damages during shipping. However, if you receive any object damaged during transport, you must notify us of this damage within 24 hours after its reception to customer@denomadebrand.com.

If passed 30 days after you have received the shipping confirmation, you have not received the order you may contact us at the email address above to ask for the return of the paid amount.

 

GIFTS

All DENÓMADE products are shipped in our branded packaging with no price information included. A delivery note in which the price is omitted will be attached to the parcel. During the checkout process, you have the option to add a personal message that we will include in a card inside the package. 

 

PURCHASE PROCESS AND SECURE PAYMENT

Most of the DENÓMADE products are made to order especially for you. This particular is clearly reflected at the product description, using expressions such as: “made to order”, “made-to-order”, “handmade especially for you”, “made especially for you”, “handmade specifically for you”, “made specifically for you”, “customized”, “custom-made”, “custom”, and any other term referring to this characteristic. In any case, the purchase process is the same for both made-to-order and stock products of immediate availability.

The purchase process consists of selecting the article/s you want to buy by the “Add to cart” or “Buy it now” button. In the first case, you should click on the cart icon or the “View cart” button and then on the “Checkout” button. You will then be directed to our secure checkout area, where you will be able to select from various payment methods:

-Visa

-Mastercard

-Maestro

-American express

-Apple Pay

-Google Pay

-Shop Pay

-PayPal.

 

In some cases, after pressing the “Complete order” button, you may be directed to your bank´s webpage where you will be asked for an extra security password (3D Secure Code system)that should be given to you by your bank.

You can choose a billing address different from the delivery address.

It is your responsibility to make sure that all the information is correct before submitting the order.

We will then send you a confirmatory email to acknowledge that we have received your order. After sending you the acknowledgment email we will check to make sure we are able to fulfill your order. Where we accept your order, we will confirm such order by sending you a second email confirming your order, confirming dispatch of the Product(s) to the delivery address you have requested in the case of the stock products, or informing you that we are going to start the handcrafted process and the estimated manufacturing time, in the case of the made-to-order articles.

We are not liable if stock of a product or any of its parts is unavailable at any given time. In the case of an issue with ordered products stock, we will contact you within 48 business hours after purchase to offer a solution.

 We are not obliged to accept your order and may, at our discretion, decline to accept your order, in which case we will refund the complete order amount.

 

PRICE AND INVOICING

The prices of our products are shown in euros. These prices include VAT (when applied), but do not include the shipping costs (when needed), nor custom fees that may be applied upon arrival to countries outside the European Union. It is your responsibility to know and to pay those custom fees.  

Prices may change at any time, but any such changes will not affect orders for which the order confirmation has already been sent.

You expressly authorize us to issue the invoice in electronic format. However, at any time you can request a hard copy of your invoice, in which case we will issue and send you the invoice on paper. Any pricing information is inside the parcel, only a delivery note without the price will be included.

 

PRODUCT INFORMATION AND CARE GUIDE

Please, note that most of our DENÓMADE products are handcrafted using natural materials. For this reason, each one of them may show unique characteristics in texture, colors, knots, grain, etc. These variations will not be considered defects or flaws, but they should be accepted and appreciated as part of the individual and unique nature of the product. 

You may find a specific care guide for each product on our website.

In general, to maintain and conserve your item in its best condition, we recommend not to expose it to extreme temperatures or prolonged and direct sources of light. Please, avoid contact with chlorinated or salt water,  perfumes or cosmetics. We recommend storing the product in its original packaging. 

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your device monitor's display of any color will be accurate. 

Certain products may have limited quantities and are subject to return or exchange only according to our Return Policy.

DENÓMADE allows you to customize certain products by adding characters and texts. In case you acquire any of these products, you declare that you are authorized to use the texts and other elements that form part of the customization. We reserve the right to refuse or cancel orders of customized products if such customization includes content that we consider to be inappropriate, property belonging to third parties, or other illicit material. You will be solely responsible for the content of the customization.

We reserve the right to limit the sales of our products to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

 

EXCHANGES AND RETURNS

Our priority at DENÓMADE is your satisfaction and the continuous improvement of our products, so we will be glad to get your comments and suggestions about the acquired products through our website via email to customer@denomadebrand.com. 

In case you want to proceed to the exchange or return of any product, please, make sure you know our Exchange and Return policy described below:

Most of our products are made to order especially for you. For this reason, we will not accept any exchange or return under any circumstances. 

All those product descriptions containing “made to order”, “made-to-order”, “handmade especially for you”, “made especially for you”, “handmade specifically for you”, “made specifically for you”, “customized”, “custom-made”, “custom”, or any other terms showing that the product is made individually and specifically for you, does not admit any exchange or return under any circumstances.You may exchange or return any of the rest of the products within 14 working days following the date of delivery.

If you would like to exchange or return an item or items purchased at our store, you should email us at customer@denomadebrand.com and follow the instructions given, which basically consist of the following:

1. The client should return the item to our facilities in its original packaging. The client has full responsibility for this shipping. We are not responsible for any charge, damage, misplacement, or delay during this shipping process.
2.  Once the item was received at our facilities, we will notify you by email, and we will check that the item comes in its original packaging, in perfect conditions, and without signs of use. If so, we will immediately proceed to dispatch the replacement item, or to the price refund, as the case may be. However, if any damage or sign of use was observed in the item, the exchange or refund request will be declined, and the item will be returned to the client, who will bear the costs for the shipment.

DENÓMADE will refund the amount paid to the card with which you made the payment and only to the original purchaser. This process might take up to 15 days, counting from the reception of the returned item at our facilities and our refund approval.

Only returns from the same country or territory that the item was shipped to, as indicated at the order confirmation stage of purchase, will be permitted.

The client will bear the shipment costs deriving from any product exchange or return, excepting those cases in which a manufacturing fault will occur.

Most of our products are delicate and made of natural stones and materials, so you should follow the specific care instructions for each product, which are available on our website. We will not accept exchanges or returns for any flaw derived from the misuse of the item. It includes: Chipped, cracked or broken gemstones, pearls, or shells; broken chains and clasps, and general wear and tear signs, such as faded plating, twisted and snapped parts, or any other flaw caused by the disregard of the care instructions mentioned above.

It is your responsibility to check your purchase upon receipt.

In the event an item is deemed faulty, DENÓMADE reserves the right to either repair, replace or refund the item at no additional cost to the customer. In this case, you should email us at customer@denomadebrand.com within 90 days after the delivery. Instructions about how to proceed will be given to you after we have received your email. We will assume the shipping costs derived from the exchange or return of any deemed faulty item or any item with a manufacturing fault. 

In any case, to exchange or return any article(s), it/they must be in perfect condition, and returned in its/their original packaging, along with all the accessories.

 

LIABILITY AND LIMITATION OF LIABILITY

Our liability in relation to any product acquired on our website, unless expressly indicated in these Terms and Conditions, is limited strictly to the purchase price of this product.

Unless there is a legal ruling to the contrary, we will not accept any liability, regardless of their origin, for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, and without limitation:

-loss of income or sales;

-loss of business;

-loss of earnings or loss of contracts;

-loss of anticipated savings;

-loss of data;

-loss of management time or office hours.

 Due to the open nature of this website and the possibility of errors occurring in the storage and transmission of digital information, we do not guarantee the accuracy and security of the information transmitted or obtained from this website, or that your use of our website will be uninterrupted, timely, or error-free. 

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the website is at your sole risk.

We will accept no liability for any failure to comply or delay in complying with any contractual obligations if this should be due to events beyond our control ("Force Majeure"). Force Majeure includes any action, event, failure to act, omission, or accident that is beyond our control, including but not limited to:

-Fire, explosions, storms, floods, earthquakes, sinking, epidemic, or any other natural disaster.

-Unavailability of use of public or private communications systems.

-Unavailability of trains, boats, planes, motor vehicles, or other means of transport, whether public or private.

-Acts, decrees, legislation, regulations, or restrictions by any government or public authority. 

Our obligations will be understood to be suspended during the period in which the Force Majeure situation remains in effect and shall be granted an extension in the period of time in which our obligations must be fulfilled by a period as long as the duration of the Force Majeure event. We will make every effort to bring the Force Majeure event to an end or find a solution that will let us fulfill our obligations despite the Force Majeure event.

PARTIAL ANNULMENT

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The failure of us to require you to comply strictly with your obligations arising from a contract or from these Terms of Service, or if we do not exercise the rights or take the actions to which we are entitled by virtue of such a contract or these Terms of Service, this will not constitute a waiver of such rights or actions.
